Terms of Service for DLSS 5 Swapper
Effective date: October 21, 2026
These Terms of Service (“Terms”) govern your access to and use of
DLSS 5 Swapper
, including the website located at
https://dlss5swapper.org
, downloadable Windows builds, setup guides, release updates, optional one-time sponsorships or paid download access, and any related services (collectively, the “Services”). By accessing or using the Services, completing checkout, or making a payment, you agree to be bound by these Terms and by our
Privacy Policy
. If you do not agree, do not use the Services or complete payment.
User Accounts & Registrations
If any part of the Services requires account creation or registration:
-
You must provide accurate, current, and complete information.
-
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at
[email protected]
if you suspect unauthorized access.
Acceptable Use & Conduct
DLSS 5 Swapper is a Windows desktop tool for installing, managing, and restoring NVIDIA DLSS 5 on PC games and supported emulators. You agree to:
-
Comply with all applicable local, state, national, and international laws, including copyright and intellectual property laws.
-
Use the software only with games and emulators you are legally entitled to run.
-
Treat DLSS 5 Swapper as a
single-player
tool. Swapping or injecting files can look like tampering to anti-cheat systems (including VAC, Easy Anti-Cheat, and BattlEye) and may cause crashes, blocked launches, or account bans.
-
Not use DLSS 5 Swapper to disable, bypass, or evade anti-cheat. The app may warn on detected anti-cheat titles; it does not bypass them.
-
Not interfere with or disrupt the security, integrity, or performance of the Services, including attempting to scrape or overload Site infrastructure.
Intellectual Property Rights
-
DLSS 5 Swapper retains all rights to its original software, website code, branding, artwork, and documentation provided through
https://dlss5swapper.org
, except where an open-source license applies.
-
The Windows app is released under the MIT License. You may use, modify, and distribute the source code in accordance with that license and any third-party notices bundled with a release.
-
NVIDIA, DLSS, GeForce, RTX, and related marks are property of NVIDIA Corporation. Game titles, stores, and emulator names are property of their respective owners. DLSS 5 Swapper is an independent project and is not affiliated with, endorsed by, or sponsored by NVIDIA or any game publisher.
When participating in external platforms (such as GitHub or Nexus Mods):
-
Maintain respectful and constructive interactions.
-
Avoid posting or linking to pirated content or illegal software downloads.
Third-Party Links & Components
The Services may link to or bundle third-party components (such as ReShade, Feeder, OptiScaler, RenoDX, or dgVoodoo2) and may link to GitHub, Nexus Mods, or NVIDIA driver pages. Those projects and sites are governed by their own terms and licenses. DLSS 5 Swapper is not responsible for third-party content, compatibility, or practices.
Nature of paid offerings
From time to time, the Services may offer optional paid options, including:
-
Support / sponsorship
on the
Support
page (currently a one-time amount such as
$4.99 USD
); and
-
Paid download or similar one-time checkout
that unlocks or starts a download after payment.
These are
voluntary, one-time payments
. They are
not
subscriptions, do
not
auto-renew, and are
not
sales of a physical product or of a separate commercial software license beyond what the project already provides under its applicable open-source or distribution terms.
Paid offerings unlock
digital, intangible benefits
that may include (as described at checkout): ad-free browsing on this website and/or free downloads of software made available on this website. Benefits are delivered electronically and are generally available
immediately
after successful payment confirmation.
Current pricing and benefit descriptions are shown on the relevant checkout or Support page at the time of purchase. We may change prices or benefits prospectively; changes do not alter amounts you already paid.
Billing & payment
-
Checkout is processed by our third-party payment processor (
Stripe
). By submitting payment, you authorize Stripe (and us) to charge your selected payment method for the displayed one-time amount.
-
You may pay with major cards and other methods Stripe makes available in your region. Currency may be shown in USD or a local equivalent displayed at checkout.
-
We do
not
store your full payment card details on our servers. Card data is handled by Stripe under its terms and privacy practices.
-
You are responsible for providing accurate billing information and for any taxes that apply in your jurisdiction, unless we expressly collect tax at checkout.
-
A charge may appear on your statement under a descriptor related to DLSS 5 Swapper, Stripe, or the product name shown at checkout. Keep your Stripe receipt for your records.
Cancellation policy
Because Support and paid download checkouts are
one-time charges with no subscription
:
-
There is
no recurring plan to cancel
after a successful payment.
-
Completing payment is final for that transaction. You cannot “cancel” a completed one-time sponsorship or paid download after the charge succeeds in order to reverse the purchase.
-
If checkout is abandoned or fails before payment succeeds, no charge should be completed; you may try again.
If you believe a payment was started in error before it completed, close the checkout session and do not confirm payment. For completed charges, see the refund policy below.
Important: Completed Support / sponsorship payments are non-refundable.
Because digital benefits (such as ad-free access and free downloads) are delivered or made available immediately after payment, and because sponsorship is a voluntary contribution to operate the Services:
-
All completed Support / sponsorship payments are final and non-refundable.
-
We do
not
offer refunds, cancellations, partial refunds, credits, or chargebacks for completed sponsorships, including change of mind, unused benefits, or dissatisfaction after delivery.
-
Paid download or other one-time digital unlocks, once payment succeeds and download or access is made available, are likewise
non-refundable
, except where a billing error listed below applies or where mandatory law requires otherwise.
Limited exceptions (billing errors only):
-
Duplicate or erroneous charges
caused by a confirmed billing or system error (for example, charged twice for the same successful checkout): we will refund the duplicate/erroneous amount after verification.
-
Failed checkout with incorrect charge
: if you were charged when no successful unlock or benefit was granted, contact us with proof of payment and we will investigate and correct confirmed errors.
How to report a billing error
Email
[email protected]
before
filing a dispute with your bank or card issuer when possible, and include:
-
The email used at checkout (if any);
-
Stripe receipt, payment intent / session ID, or transaction ID;
-
Date/amount charged and a short description of the issue.
We aim to acknowledge billing-error reports within
2 business days
and to resolve confirmed errors within
5 business days
where practicable (refund timing may also depend on Stripe and your bank).
Statutory rights.
If applicable law in your country grants non-waivable withdrawal or refund rights for digital content (for example, certain EU/UK consumer rules), those rights apply only to the extent required by law. Where you expressly request immediate delivery of digital content and acknowledge that you lose the right of withdrawal, we may rely on that acknowledgment as permitted by law.
Billing disputes
If you believe a charge is incorrect, contact
[email protected]
first so we can review the transaction. Filing a chargeback without contacting us may delay resolution. Unfounded chargebacks on valid, completed sponsorships may result in suspension of related website benefits.
Disclaimers & Limitation of Liability
-
The Services and downloadable builds are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
-
DLSS 5 Swapper does not guarantee compatibility with every game, emulator, renderer, or GPU. Image quality and performance can vary, especially on cards older than RTX 50. Compatibility is not guaranteed; existing mods may conflict.
-
Official NVIDIA DLSS 5 is aimed at RTX 50 series GPUs. Community routes for older cards are unsupported by NVIDIA.
-
To the fullest extent permitted by law, DLSS 5 Swapper, its maintainers, and contributors will not be liable for any indirect, incidental, or consequential damages arising from your use of the software or website, including game crashes, lost saves, or anti-cheat penalties.
Termination
We reserve the right to suspend or terminate your access to the Services at any time if you violate these Terms or pose a security risk.
Changes to Terms
We may update these Terms from time to time. When changes occur, we will post the revised Terms on
https://dlss5swapper.org
and update the effective date at the top. Continued use after changes become effective constitutes acceptance.
